What’s the Difference Between State and Federal Trademarks? 

  • Florida State Trademarks have a faster turnaround time, while Federal Trademark Registration can sometimes take over a year to register.
  • State Trademarks don’t cost as much to register as Federal Trademarks.
  • A Florida State Trademark will only provide coverage within the State’s borders. Federal Trademarks provide coverage nationwide.
  • State Trademarks allow you to use the “TM” or “SM” suffix. Federal Trademarks allow for the “®” symbol.
  • Federal Trademark protections are stronger overall, and allow for some enforcement across social media. They are preferable to State Trademarks, budget permitting.
